LEGAL REQUIREMENTS

The Regulatory Reform (Fire Safety) Order 2005, places responsibility for fire safety squarely on the “responsible person” which may be an employer, landlord or any person who has (to any extent) control over the workplace or premises. The responsible person is required to ensure that a suitable and sufficient fire risk assessment is carried out for the workplace or premises.

This legal requirement aims to ensure that organisations take proactive actions based on the findings of fire risk assessments for prevention, detection and dealing with the fires.

It is recognized that more than half of the businesses affected by a major fire do not recover or fail within three years. A number of high profile prosecutions have also been successfully brought against organisations who have failed to carryout suitable and sufficient fire risk assessments.
